The article analyzes the international law concerning the human right to health through a Venezuela Supreme Court Case, Cruz Bermudez v Ministerio de Sanidad y Asistencia Social, that dealt with access to antiretrovirals for persons living with HIV/AIDS. The article looks at the problems that have made the right to health a difficult concept to define and implement in international law. These problems become central features of the Bermudez case. The article analyzes how Venezuelan law incorporates the right to health, the arguments of the parties in the case, and the holding of the Venezuelan Supreme Court in favor of the persons living with HIV/AIDS. The article concludes by considering the lessons the Bermudez case holds for the human right to health in international law.
