The development concerns the Hague Convention on the Civil Aspects ofInternational Child Abduction. Many national signatories do not complywith the treaty. I find that this non-compliance is facilitated by thetreaty's reliance on a 'best interest of the child' standard that islargely subjective and allows judges to make discretionary decisions thatmay in part be motivated by gender and national biases as well as theacclimatization of a child to his new environment due to judicial delays.
